The Formula One ace – who has been in critical condition since hitting his head on a rock while skiing in the French Alps last Christmas – is accused of colliding with the biker after failing to give way at a roundabout in Bormujos near Seville.
The 45-year-old ex-sportsman, who is currently in a medically-induced coma, would not be obliged to attend a trial date if insurers contest the claim.
A police report states that Michael, who was on a private visit to Spain at the time, failed to respect his alleged victim's right of way.
Poor lighting on the approach to the roundabout has also been blamed.

It read: "We are on his side during his long and difficult fight, together with the team of the hospital in Grenoble, and we keep remaining confident.
"This is necessary to protect the privacy of Michael and his family, and to enable the medical team to work in full calmness."
Michael's rep also rubbished claims his wife Corinna had plans to build a medical suite for him at their Swiss home.
